    Heart is pissed off.

    LOS ANGELES - The rock group Heart, angry that its 70’s hit “Barracuda” is being used as the unofficial theme song for Republican Vice Presidential nominee Sarah Palin, is biting back at the Alaska governor.

    The song, a nod to the “Sarah Barracuda” nickname Palin earned on the basketball court in high school, was dusted off for her appearance at the Republican National Convention in St. Paul on Wednesday.

    Heart singers Ann and Nancy Wilson said a “cease-and-desist” letter has been sent to the Republicans asking them not to use the song.

    “The Republican campaign did not ask for permission to use the song, nor would they have been granted that permission,” according to a statement issued late on Thursday on behalf of the sisters.

    There was no immediate comment from the Republican camp.

    Last month, rocker Jackson Browne sued Republican presidential candidate John McCain, the Republican National Committee and the Ohio Republican Party, accusing them of using his 1977 hit “Running on Empty” in a campaign ad without permission.

    Copyright law may not be on the Wilsons’ side as the song is licensed for public performance under a blanket fee paid by the venue to ASCAP, the firm that collects royalties on behalf of composers and copyright owners.

    LOS ANGELES - To mark Playboy’s 55th anniversary in January, the magazine has approached Lindsay Lohan about doing a nude pictorial, Access Hollywood has confirmed.

    But it appears even an offer of $700,000 couldn’t persuade the actress to bare her breasts.

    And while Lohan has been photographed sans top before — in last year’s tribute to Marilyn Monroe in New York magazine — she is now done posing for naked pictures.
    “She’d be happy to do the cover, but no nudity,” Lohan’s rep told Access.

    The theme for the proposed layout was based on “Kitten With a Whip,” which starred Ann-Margret, and is Lohan’s favorite film. But, as Lohan’s rep pointed out, there wasn’t any nudity in that film either.

    Her rep added that Lohan was “flattered” by the offer, but felt, at this point in her career, the 22-year-old doesn’t need to take her clothes off.

    Did anyone else see this, from MC Lyte:

    Prior to today’s game, Jerry Manuel told reporters that Jon Niese will start on Tuesday against the Nationals in Shea Stadium.

    This, to me, whill be a much more telling sign of Niese’s potential, in that it is home, his second start, and, I am hesitant to say this, against the Nationals.

    Or, am I just late to the party?

    Wagner throws, is ready for simulated game

    Billy Wagner already has thrown a bullpen session today, and feels ready at this point to face hitters Sunday, in what is expected to be a simulated setting at Shea. He said he gets stiffness, which is understandable and fine, but the elbow inflammation is gone. While the original estimate for activation was Tuesday, Wagner conceivably could wait until next weekend’s series against Atlanta.

    UPDATE: Jerry Manuel said Wagner’s first use may be in a non-save situation if he’s not going to pitch in a minor-league game.

    NEW YORK — David Spade is the father of a newborn girl.

    Spade’s representative said that Playboy playmate Jillian Grace is the mom. The baby was born Aug. 26 in Missouri.

    The actor-comedian plans to visit her on his first break from filming “Rules of Engagement.”

    Spade, who’s 44, had told TMZ.com earlier this year he had a brief relationship with Grace, and would accept responsibility if it’s confirmed he was the dad.

    Tonight is a good matchup for us. The Mets really struggle against righties. One thing of concern is that the Phillies haven’t faced Pelfrey since he turned his season around in June. I hope our scouting reports have been updated.
